Terms of Service

1. Acceptance of Terms

By accessing or using OnlyStudentStay ("the Platform", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

2. Eligibility

To use OnlyStudentStay, you must:

• Be a currently enrolled student at a recognised university or higher education institution
• Have a valid university email address
• Be 18 years of age or older
• Not be prohibited from using the Platform under applicable law

3. The Platform

OnlyStudentStay is a free student-to-student accommodation platform. We provide a space for verified students to list and find accommodation. We are not:

• A letting agent or property management company
• A party to any rental agreement between students
• Responsible for verifying the physical condition, legal status, or suitability of any property listed
• Responsible for any financial transactions between users

All accommodation arrangements are made directly between students. OnlyStudentStay does not handle payments, deposits, or rental agreements.

4. Listing a Room

When you list a room on OnlyStudentStay, you agree that:

• All information provided is accurate and up to date
• You have the legal right to sublet or offer the accommodation listed
• Photos uploaded are genuine photos of the actual property
• The listed rent and availability dates are correct at the time of listing
• You will respond to genuine enquiries promptly and in good faith
• You will notify us or remove the listing once the room is no longer available

Listings are subject to email verification before going live. We reserve the right to remove any listing that violates these Terms or appears fraudulent.

5. Finding a Room

When you search for and enquire about rooms on OnlyStudentStay, you agree to:

• Only make genuine enquiries about rooms you are seriously interested in
• Treat room listers with respect in all communications
• Independently verify the property before entering into any agreement
• Not share contact details of room listers with third parties

We strongly recommend that you:

• View the property in person before signing any agreement
• Never pay a deposit without a signed tenancy agreement
• Verify the lister is who they say they are before transferring any money

6. Prohibited Conduct

You must not use OnlyStudentStay to:

• Post fake, misleading, or fraudulent listings
• Impersonate another student or person
• Harass, threaten, or abuse other users
• Share personal data of other users without their consent
• Use the Platform for any commercial purpose (letting agents, landlords, property companies)
• Scrape, copy, or reproduce Platform content without permission
• Attempt to bypass our email verification system
• Post discriminatory listings or messages based on race, gender, religion, disability, or any protected characteristic
• Use the Platform for any illegal purpose

Violations will result in immediate removal from the Platform and may be reported to relevant authorities.

7. Limitation of Liability

OnlyStudentStay provides the Platform on an "as is" basis. To the maximum extent permitted by law:

• We do not guarantee the accuracy of any listing on the Platform
• We are not liable for any loss, damage, or expense arising from use of the Platform
• We are not responsible for any agreements, payments, or disputes between users
• We do not guarantee continuous, uninterrupted access to the Platform

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence.

8. Intellectual Property

The OnlyStudentStay name, logo, design, and Platform code are owned by OnlyStudentStay and protected by intellectual property law.

By uploading photos or content to the Platform, you grant OnlyStudentStay a non-exclusive, royalty-free licence to display that content on the Platform for the purpose of operating the service.

You retain ownership of all content you upload. You may request removal of your content at any time by contacting us.

9. Termination

We reserve the right to suspend or permanently remove any user or listing from the Platform at our sole discretion, including if we believe a user has violated these Terms.

You may request deletion of your account and data at any time by contacting us at eemran@onlystudentstay.com.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
